1. Acceptance of terms
By creating an account or using Nexwapi (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. The service
Nexwapi provides tools to send, receive, automate, and analyse WhatsApp messages via Meta’s official WhatsApp Business Platform. You are responsible for obtaining valid WhatsApp Business API access and complying with Meta’s policies.
3. Acceptable use
- You must obtain proper opt-in consent from recipients before messaging them.
- You must not send spam, unlawful, deceptive, or abusive content.
- You must comply with the WhatsApp Business Messaging Policy and Commerce Policy.
- You must not attempt to disrupt, reverse-engineer, or misuse the Service.
4. Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised use.
5. Fees & billing
Paid plans are billed as described on our Pricing page. WhatsApp conversation charges set by Meta are billed in addition to plan fees. All fees are exclusive of applicable taxes (e.g., GST) unless stated otherwise.
6. Third-party services
The Service relies on Meta’s WhatsApp Business Platform. Your use of WhatsApp is also subject to Meta’s and WhatsApp’s terms. Nexwapi is not affiliated with or endorsed by Meta.
7. Intellectual property
Nexwapi and its logos are our property. You retain ownership of your content and contact data; you grant us a limited licence to process it solely to provide the Service.
8. Disclaimer & limitation of liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Nexwapi is not liable for indirect, incidental, or consequential damages, or for message delivery failures caused by Meta or third parties.
9. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or applicable policies.
10. Changes
We may update these Terms; continued use after changes constitutes acceptance.
